PARTICIPANT WAIVER, RELEASE & ASSUMPTION OF RISK

Quiet on the Creek
Deep Creek, Maryland
April 8–11, 2027

READ PARTICIPANT WAIVER
XSCAPES INC. PARTICIPANT WAIVER, RELEASE & ASSUMPTION OF RISK Quiet on the Creek Deep Creek, Maryland April 8–11, 2027 PLEASE READ CAREFULLY This Participant Waiver, Release & Assumption of Risk (“Agreement”) applies to my voluntary participation in Quiet on the Creek, an XSCAPES Inc. experience taking place April 8–11, 2027, in Deep Creek, Maryland (the “Experience”). By electronically accepting this Agreement, I acknowledge that I have carefully read and understood its terms and voluntarily agree to them as a condition of participating in the Experience. 1. VOLUNTARY PARTICIPATION I understand that my participation in Quiet on the Creek and any associated activities is entirely voluntary. I understand that the Experience may include lodging in a private vacation property, meals, alcoholic and non-alcoholic beverages, entertainment, games, social activities, use of common areas and property amenities, and other recreational or group activities. I understand that I am never required to participate in any particular activity and may decline or discontinue participation when I believe doing so is appropriate for my health, safety, comfort, or personal circumstances. 2. ACKNOWLEDGMENT & ASSUMPTION OF RISK I understand that travel and participation in a group experience may involve inherent and other risks, both known and unknown. Such risks may include, but are not limited to: • Slips, trips, and falls; • Stairs, decks, walkways, uneven or slippery surfaces; • Snow, ice, rain, cold temperatures, severe or changing weather conditions; • Limited lighting and reduced visibility, particularly after sunset; • Encounters with wildlife, insects, plants, or other natural conditions; • Lakes, streams, bodies of water, waterfront areas, docks, and wet surfaces; • Fireplaces, fire pits, grills, cooking equipment, and other heat sources; • Hot tubs, pools, or similar amenities if available at the lodging property; • Recreational activities, games, entertainment, and physical activities; • Food-related illness or allergic reactions; • Consumption of alcoholic beverages; • Acts or conduct of other participants, guests, property owners, vendors, or third parties; • Travel to and from Deep Creek and transportation undertaken during the Experience; • Loss, theft, or damage to personal property; and • Other risks ordinarily associated with travel, lodging, social gatherings, recreational activities, and unfamiliar environments. I voluntarily choose to participate with knowledge of these risks and knowingly assume the ordinary and inherent risks associated with my participation in the Experience. 3. DEEP CREEK & AFTER-DARK SAFETY I understand that Deep Creek is a rural and natural environment where roads, pathways, outdoor areas, and surrounding property may become extremely dark after sunset and where wildlife may be present. XSCAPES strongly recommends that participants: • Plan their arrival before dark whenever reasonably possible; • Exercise additional caution when driving or walking after sunset; • Carry and use a flashlight or other appropriate lighting when outdoors after dark; • Remain aware of their surroundings and potential wildlife; • Avoid approaching, feeding, or interacting with wildlife; and • When reasonably possible, travel or walk with at least one other person when outside after sunset. I understand that these recommendations are intended to promote participant safety and do not eliminate the risks associated with the environment. 4. TRANSPORTATION I understand that transportation to and from Deep Creek, Maryland is not included in my reservation unless XSCAPES expressly states otherwise in writing. I am responsible for arranging my own transportation and determining whether any driver, vehicle, transportation provider, or transportation arrangement I use is appropriate for me. If I voluntarily ride with another participant or third party, I understand that I do so at my own discretion. XSCAPES does not guarantee independently arranged transportation, transportation schedules, vehicle conditions, road conditions, or the conduct of drivers or transportation providers not operated by XSCAPES. 5. ALCOHOL I understand that alcoholic beverages may be available during the Experience. I agree that: • Consumption of alcohol is voluntary; • I am responsible for monitoring my own alcohol consumption; • I will not operate a motor vehicle while impaired; • I will comply with applicable laws concerning alcohol consumption; and • I remain responsible for my own actions and decisions relating to alcohol. I understand that XSCAPES may refuse to serve alcohol to, or discontinue alcohol service for, a participant when XSCAPES reasonably believes doing so is appropriate for safety or legal compliance. 6. HEALTH, MEDICAL CONDITIONS & EMERGENCIES I am responsible for determining whether I am physically and medically able to participate safely in the Experience and in any particular activity. I agree to disclose relevant food allergies or dietary restrictions through the reservation process so XSCAPES can reasonably plan for the Experience. I understand that XSCAPES cannot guarantee an allergen-free environment or the absence of cross-contact. In the event of an emergency, I authorize XSCAPES representatives to contact emergency medical services and/or the emergency contact I provided when reasonably necessary. I understand that XSCAPES personnel are not necessarily medical professionals and that XSCAPES does not undertake a duty to provide medical treatment. I remain responsible for medical expenses incurred on my behalf. 7. PERSONAL PROPERTY I am responsible for securing my own money, luggage, electronics, jewelry, clothing, identification, medications, and other personal belongings. To the extent permitted by applicable law, I understand that XSCAPES is not responsible for ordinary loss, theft, misplacement, or damage to personal property occurring during the Experience except to the extent liability cannot lawfully be waived or limited. 8. THIRD-PARTY PROPERTIES, SERVICES & ACTIVITIES I understand that XSCAPES may use vacation rental properties, chefs, entertainers, transportation providers, activity providers, vendors, contractors, property owners, or other independent third parties in connection with the Experience. Certain third parties may maintain their own rules, restrictions, waivers, or terms of participation. I agree to comply with reasonable property rules and applicable requirements communicated to participants. 9. RELEASE & WAIVER OF CLAIMS TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, I voluntarily release and discharge XSCAPES Inc., together with its directors, officers, founders, employees, volunteers, representatives, and agents (collectively, the “Released Parties”), from claims arising from the ordinary and inherent risks of my voluntary participation in the Experience, including claims arising from ordinary negligence to the extent such claims may lawfully be released. This release is intended to apply only to the fullest extent permitted by applicable law. Nothing in this Agreement is intended to release, waive, or limit liability that cannot legally be released, waived, or limited under applicable law. 10. PARTICIPANT CONDUCT, SAFETY & ZERO-TOLERANCE POLICY I agree to conduct myself responsibly and respectfully throughout the Experience and to follow reasonable safety instructions, property rules, and participant guidelines communicated by XSCAPES. XSCAPES maintains a zero-tolerance policy for violence, threats of violence, fighting, physical aggression, harassment, intimidation, threatening behavior, or other conduct that reasonably jeopardizes the safety or well-being of participants, XSCAPES representatives, vendors, property owners, or others. Any participant who engages in such conduct may be required to leave the premises and/or the Experience immediately when XSCAPES reasonably determines removal is necessary for the safety and well-being of others. If I am removed from the Experience because of my conduct, I understand that: • I will be responsible for arranging and paying for my own transportation from the premises; • I will be responsible for expenses resulting from my removal; and • Removal for violation of this policy will not entitle me to a refund of amounts already paid to XSCAPES, to the extent permitted by applicable law. Nothing in this Agreement prevents XSCAPES, a property owner, participant, or other individual from contacting law enforcement or emergency services when reasonably necessary. 11. WEAPONS & FIREARMS POLICY For the safety and comfort of all participants, weapons are prohibited at the Quiet on the Creek Experience and within XSCAPES-controlled lodging or event spaces, to the extent permitted by applicable law and applicable property rules. This prohibition includes firearms and other weapons brought onto the premises in violation of the policy communicated by XSCAPES or the property owner. I agree to comply with all applicable federal, state, and local laws, property rules, and XSCAPES safety policies concerning weapons. A violation of this policy may result in immediate removal from the Experience when permitted by law. If I am removed for violation of this policy, I understand that I am responsible for my transportation and expenses associated with leaving the premises and that removal will not entitle me to a refund of amounts already paid to XSCAPES, to the extent permitted by applicable law. XSCAPES may contact property management, security, law enforcement, or emergency services when reasonably necessary to address an actual or suspected safety threat. 12.
